The Breathing Space scheme (formally the Debt Respite Scheme) was introduced in England and Wales in May 2021. It gives eligible people in problem debt 60 days of legal protection — interest and charges are frozen, enforcement is paused, and you have space to find a sustainable solution with a debt adviser.
The two types
Standard Breathing Space: available to anyone in problem debt seeking help from a professional debt adviser. Lasts 60 days. Interest and most charges frozen, enforcement paused, creditors cannot contact you.
Mental Health Crisis Breathing Space: for people receiving mental health crisis treatment. Lasts for the duration of treatment plus 30 days. Stronger protections.
Who can apply and how
You must apply through a registered debt adviser — you cannot apply directly. Eligible services include StepChange, National Debtline, Citizens Advice and authorised local advice agencies. You are not eligible if already in a Debt Relief Order, IVA, bankruptcy, or had a Breathing Space in the last 12 months.
What it does and does not protect against
- Freezes: most unsecured debt interest and charges, enforcement action, certain court proceedings
- Does NOT freeze: rent and mortgage arrears, child maintenance, criminal fines
- You must continue making affordable payments during the period where possible
After Breathing Space ends
Breathing Space is a period to find a solution — not a solution itself. During the 60 days, your adviser will work with you on a sustainable approach: Debt Management Plan, formal insolvency, or negotiated arrangements. At the end, creditor action and charges resume if no arrangement has been made.
